Absract. The subject of the current scientific research are the matters arising from the analysis of legal regulations in the Higher Education Act regarding the rules on the method of determining the amount of the minimum monthly basic salary, the accrual and payment of which are an obligation of each state higher education institution in its capacity of an employer under employment regulations, in view of the academic position “assistant”. The constituent elements of the mathematical formula established by the legislator for the calculation of the mandatory minimum, which the Council of Ministers should regulate through its act, have been analysed. The exact amount of the considered employment remuneration has been calculated, the establishment of which only determines the legality of the adopted normative administrative act. Proposals have been formulated aimed at the improvement of the legal framework.
